Were you recently ordered removed by an immigration judge?
If a judge ordered you to leave the United States, you may have the right to ask a higher court to review that decision. This is called a BIA appeal. A BIA appeal does not involve any hearings or in‑person court appearances. Instead, everything is done in writing. You and the government each submit written arguments, called briefs, and the Board makes its decision based only on those written documents.
Did you receive a negative decision from the Board of Immigration Appeals?
If the BIA ruled against you, you may be able to take your case to a federal court. In New York, that means filing a Petition for Review in the Second Circuit Court of Appeals. Taking a case to federal court is complicated and very different from going back to immigration court. There are many different types of decisions by the BIA that can be challenged in a petition for review.
